PROPERTY MODIFICATIONS - ACC APPROVAL
All property modifications require ACC approval from the Architectural Control Committee. You can access the fillable ACC request form on the Abbey Moor website at https://abbeymoorhoa.com/, documents, architectural documents, and ACC fillable form. The ARC committee must receive a complete application to review, or this will cause a delay. The homeowner compiles their home improvement request, which typically includes the homeowner’s contact information, a project description, plat maps, visual distance/measurements from fence lines, the project location, paint samples, materials to be used, web snippets labeled with the color or product material, the dimensions of the finished project, and the estimated start and end dates of the project. Please attach all supplemental information when submitting a completed ACC request form. We have included a supplemental guide to provide additional assistance.
Property Modifications/Exterior changes include but are not limited to: landscape borders, house color, front doors, major landscaping changes, exterior light fixtures, roof color, fences and stain color, tree removal/install, swimming pools, solar panels, etc. To be on the safe side, don't change anything on the outside of your home or property before receiving ACC approval, because it could lead to a fine or you having to remove the modification.
RESPONSABILITIES OF THE ARC COMMITTEE
It is the responsibility and role of the ARC committee to review proposals for any construction or modifications that will be done to a homeowner's property. Based on the guidelines set forth within the community's CC&Rs the committee must then approve or deny the homeowner's requests. It is important to note that members of the ARC are independent of the HOA's board of directors. The committee members that serve on the ARC are volunteers and must often discuss and review pending requests and possible issues within the community as a whole as it relates to the community's CC&Rs. The purpose of the creation of the ARC committee in a community is to enforce the CC&Rs established by the HOA. Their mission is to abide by the guidelines set forth in the CC&Rs with the goal of maintaining the community's aesthetic by assuring each property owner is following the rules set forth within the document. Oftentimes, the process of approval or denial through an ARC committee is frustrating for the homeowner members of the HOA. It is understandable that homeowners may feel inconvenienced or burdened by the need to conform to the community's CC&Rs in this manner. However, the ARC committee plays a critical role within the HOA, these volunteer committee members are in charge of making sure the community retains its appeal, uniformity, and overall property value, which ultimately benefits all of the homeowners.
Section 3.2 Establishment of ACC.
(a) Initial Appointment. The ACC shall consist of three (3) members; the initial members of the ACC shall be appointed by the Declarant.
(b) Term and Subsequent Appointments. The members of the ACC shall serve until they resign or are removed by the party appointing them to the ACC (which the appointing party may do at any time). Subsequent appointments to the ACC shall be made by the Declarant until such time as the Declarant either relinquishes such power by written notice to the Board, or the Declarant no longer owns any Lot; thereafter appointments to and removals from the ACC shall be made by the Board. The ACC or Declarant may engage the services of a third party to review plans and specifications pursuant to this Article. (c) Compensation; Fee for Review. No member of the ACC shall be entitled to compensation for its services. The ACC may impose a reasonable charge for reviewing plans.
